1. Eligibility and Accounts
You must be legally capable of entering into a binding agreement to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian.
You are responsible for providing accurate account information, maintaining the confidentiality of your credentials, and all activity that occurs under your account.
2. The Service
EarNoun is a listening game for learning English nouns. You hear a spoken word and choose the image that matches it. The Service may include themed practice sessions, audio playback, illustrated vocabulary, review flows, downloadable content packs for offline play, and progress tracking across your devices.
We may add, remove, or modify features at any time. The Service is provided for educational and informational purposes only and does not constitute professional advice.
3. Subscriptions and Payments
EarNoun offers a free tier containing a limited number of sessions, and a paid subscription that unlocks the full catalog.
App Store Transactions: If you purchase a subscription through the Apple App Store or Google Play, payment will be charged by the applicable app store. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period, in accordance with the store's rules.
Pricing: Subscriptions are offered at USD $4.99 per month or USD $39.99 per year. Prices shown in the app are localized by the app store and may differ by region and over time. The price displayed at the time of purchase governs.
Management: You can manage or cancel your subscription through your App Store or Google Play account settings. Canceling stops future renewals; it does not retroactively refund the current period.
Refunds: Refunds for app store purchases are handled by Apple or Google under their own policies. We are not able to issue refunds for transactions we did not process.
Service Providers: We use RevenueCat to validate entitlement status and restore access across your devices.
4. Acceptable Use
You agree not to:
- Use the Service in violation of any law or regulation.
- Reverse engineer, scrape, or attempt unauthorized access to the Service.
- Use bots or automation to misuse the Service or circumvent usage limits.
- Redistribute, republish, or share downloaded content packs, audio, or images outside the app.
- Copy or commercially exploit the Service content without our written permission.
We may suspend or terminate your access if we believe you have violated these Terms or used the Service in a fraudulent or abusive manner.
5. Intellectual Property
The Service, including its software, design, branding, illustrations, audio recordings, and compiled content, is owned by or licensed to the service operator and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, and revocable license to use the Service for your own non-commercial use.
Content packs downloaded to your device are licensed for offline use within the app only, and remain subject to this license.
Word definitions and lexical data are derived in part from WordNet, a lexical database developed at Princeton University, and are used in accordance with its license.
6. User Feedback
If you provide suggestions or ideas about the Service, you grant us a worldwide, perpetual, and irrevocable license to use and incorporate that feedback without restriction or compensation to you.
7. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARNOUN AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) USD $50.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, USA. Any dispute arising from these Terms will be resolved in the state or federal courts located in Los Angeles County, California.
Class Action Waiver: ANY PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION.
9. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice in the app or on our website. By continuing to use EarNoun after the updates become effective, you agree to the updated Terms.
